In the early 1970s, the Ohio General Assembly created new administrative agencies to manage and regulate Ohio’s environment and natural resources. Previously, the Ohio Water Pollution Control Board, Ohio Air Pollution Control Board, and local Boards of Health had the major responsibility for overseeing environmental concerns. However, with the enactment of SB 397 in 1972, the Ohio Environmental Protection Agency (“Ohio EPA”) and the Environmental Board of Review (now known as the Environmental Review Appeals Commission) came into being. Under Chapter 3745 of the Revised Code, Ohio EPA administers the major regulatory programs pertaining to air and water pollution, public water supply, and solid and hazardous wastes.

The Director of Ohio EPA is authorized to adopt and maintain a program for the prevention, control, and abatement of air pollution that is consistent with the federal Clean Air Act, and to obtain financial assistance and delegation of powers from the U.S. Environmental Protection Agency (“U.S. EPA”) to administer this program. Emission limits necessary to meet National Ambient Air Quality Standards are prescribed by regulation, and permits are required to install and operate air contaminant emission sources.

In conformity with the federal Clean Water Act and Safe Drinking Water Act, the Director of Ohio EPA is authorized to develop plans and programs to regulate new or existing sources of pollution of the waters of the State, including the adoption of water quality standards and effluent limitations to enable the use of Ohio’s waters for public water supplies, industrial and agricultural needs, propagation of fish and aquatic life, and recreational purposes. The Director also may issue, revoke, modify, or deny permits for the direct or indirect discharge of sewage, industrial waste, or other wastes into Ohio’s waters.

The Director of Ohio EPA has the authority to regulate solid waste facilities in the State. It is the Director’s responsibility to inspect and issue permits for the installation or modification of all solid waste facilities in order to assure that these facilities will be located, maintained, and operated in a sanitary manner so as not to create a nuisance or health hazard, or contribute to water pollution. The Director is empowered to seek appropriate legal or equitable remedies against any violator who poses a substantial threat to the public welfare or whose actions result in air or water pollution. However, the Director may delegate authority to the local Boards of Health to provide for the annual inspection, licensing, and enforcement of sanitary standards for solid waste facilities.
